Terms of Service

1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and DB Island Inc. ("Company," "we," "us," or "our"), operating the Book/Job platform at booknjob.com ("Platform").
By accessing or using the Platform, creating an account, or booking a service through the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Platform.
We may update these Terms from time to time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms. We will notify registered users of material changes via email.
2. Platform Description
Book/Job is a technology platform that enables service providers ("Providers") to create AI-generated web pages, manage bookings, and accept payments from their customers ("Customers"). The Platform serves as an intermediary tool and marketplace.
Book/Job does not provide, perform, or guarantee any of the services listed by Providers on the Platform. Each Provider is an independent business solely responsible for the quality, legality, and delivery of their services.
The Platform provides Providers with:
- AI-generated booking web pages hosted on subdomains (e.g., provider.booknjob.com)
- Online booking and appointment scheduling tools
- Payment processing facilitation via Stripe
- Customer notification and reminder systems
- A dashboard for managing bookings, services, and business settings
3. Account Registration
To use certain features of the Platform, you must create an account. You may register using Google OAuth or email/phone with one-time password (OTP) verification.
When creating an account, you agree to:
- Provide accurate, current, and complete information
- Maintain the security of your account credentials
- Promptly update your information if it changes
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized access to your account
You must be at least 18 years old to create an account. We reserve the right to suspend or terminate accounts that violate these Terms or contain fraudulent information.
4. Provider Obligations
As a Provider on the Book/Job platform, you agree to:
- Provide accurate and truthful information about your business, services, and qualifications
- Maintain all necessary licenses, permits, and insurance required for your services in your jurisdiction
- Honor confirmed bookings and provide services as described on your booking page
- Respond to booking requests and customer inquiries in a timely manner
- Set fair and transparent pricing for your services
- Comply with all applicable local, state, and national laws and regulations
- Not use the Platform to offer illegal, dangerous, or prohibited services
- Maintain your own cancellation, refund, and dispute policies as displayed on your booking page
- Keep your availability calendar and service information up to date
You acknowledge that you are an independent business and not an employee, agent, or partner of DB Island Inc. You are solely responsible for tax reporting and compliance in your jurisdiction.
5. Customer Obligations
As a Customer using the Platform to book services, you agree to:
- Provide accurate contact information and booking details
- Honor confirmed bookings and arrive on time for appointments
- Pay all applicable fees, deposits, and service charges
- Treat Providers and their staff with respect
- Communicate any special requirements or relevant information before the appointment
- Follow the cancellation and rescheduling policies set by the Provider
- Not use the Platform for fraudulent, abusive, or illegal purposes
6. Payment Terms
General
All payments on the Platform are processed by Stripe. By using the payment features, you also agree to Stripe's terms of service and privacy policy. Book/Job does not store your credit card or payment details on our servers.
Stripe Connect Model (Transaction-Based)
In countries where the Platform operates on a transaction-based model, the following terms apply:
- Customers pay a deposit or full service fee at the time of booking via Stripe
- A platform fee of 5% is automatically deducted from each transaction
- The remaining amount is transferred to the Provider's connected Stripe account
- Providers must complete Stripe Connect onboarding to receive payments
- Providers receive a free trial period of up to 60 days before payment processing is required
- Stripe's own processing fees are separate from and in addition to the 5% platform fee
Subscription Model (Invoice-Based)
In countries where the Platform operates on a subscription model, the following terms apply:
- Providers pay a monthly subscription fee to access premium features (booking calendar, dashboard, notifications)
- Subscription prices vary by country and are displayed at the time of registration
- A free trial period is provided (typically 30 days) after which the subscription is required to maintain premium access
- After the trial or upon subscription cancellation, Providers retain access to their booking page with basic lead capture functionality
- Subscriptions are billed monthly and can be cancelled at any time; cancellation takes effect at the end of the current billing period
- Payment processing for customer bookings in subscription-model countries is managed directly between the Provider and Customer, outside the Platform
Refunds
Refund eligibility for booking deposits is governed by the individual Provider's cancellation and refund policies. The Platform facilitates refund processing through Stripe when authorized by the Provider or required by the Provider's stated policies.
Subscription refunds are handled on a case-by-case basis. Please contact support@booknjob.com for subscription billing inquiries.
7. Intellectual Property
The Platform, including its design, features, functionality, software, text, graphics, logos, and all related intellectual property, is owned by DB Island Inc. and is protected by copyright, trademark, and other intellectual property laws.
Providers retain ownership of their original content (photos, descriptions, and other materials) uploaded to the Platform. By uploading content, Providers grant DB Island Inc. a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content in connection with operating the Platform.
AI-generated content created by the Platform for Provider booking pages (including text, layouts, and design elements) is provided as a service. Providers may use this content on the Platform but may not reproduce or distribute it outside the Platform without our written consent.
You may not copy, modify, distribute, sell, or lease any part of the Platform, nor may you reverse-engineer or attempt to extract the source code of any software component.
8. Prohibited Conduct
You agree not to:
- Use the Platform for any unlawful, fraudulent, or deceptive purpose
- Impersonate any person or entity, or falsely represent your affiliation with any person or entity
- Post or transmit content that is defamatory, obscene, abusive, or violates the rights of others
- Attempt to gain unauthorized access to other accounts, the Platform's systems, or networks
- Interfere with or disrupt the Platform's operations or servers
- Use automated scripts, bots, or scrapers to access or collect data from the Platform
- Circumvent, disable, or interfere with security features of the Platform
- Use the Platform to send unsolicited commercial communications (spam)
- List services that are illegal in your jurisdiction or violate applicable regulations
- Manipulate bookings, reviews, or other Platform features for deceptive purposes
9. Disclaimers
THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. DB ISLAND INC. DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not guarantee the accuracy, completeness, or reliability of any content on the Platform, including Provider listings and AI-generated content.
Book/Job does not endorse, verify, or guarantee any Provider, their qualifications, the quality of their services, or the accuracy of information on their booking pages. Customers use the Platform and book services at their own risk.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DB ISLAND INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM.
Our total aggregate liability for any claims arising out of or related to these Terms or the Platform shall not exceed the greater of (a) the total fees paid by you to us in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars (USD $100).
Book/Job is a technology platform and intermediary. We are not a party to the agreement between Providers and Customers. We are not liable for:
- The quality, safety, or legality of services provided by Providers
- The truth or accuracy of Provider listings or descriptions
- The ability of Providers to perform services or Customers to pay for them
- Personal injury, property damage, or any harm resulting from services booked through the Platform
- Disputes between Providers and Customers
11. Indemnification
You agree to indemnify, defend, and hold harmless DB Island Inc. and its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Your use of or access to the Platform
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property or privacy rights
- Any content you post, upload, or transmit through the Platform
- Services you provide or receive through the Platform
- Any dispute between you and another user of the Platform
12. Termination
You may terminate your account at any time by contacting us at support@booknjob.com or using the account deletion feature in your dashboard settings.
We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice, including but not limited to cases where:
- You violate these Terms or any applicable law
- Your account is associated with fraudulent or abusive activity
- You fail to pay applicable fees (subscription or otherwise)
- Your account has been inactive for an extended period
Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will continue to apply.
Active subscriptions will not be refunded upon termination for cause. If we terminate your account without cause, any prepaid subscription fees for the remaining billing period will be refunded.
13. Service Availability and Modifications
We strive to maintain the Platform's availability but do not guarantee uninterrupted access. The Platform may be temporarily unavailable due to scheduled maintenance, updates, or circumstances beyond our control.
We reserve the right to modify, suspend, or discontinue any feature or aspect of the Platform at any time, with or without notice. We will make reasonable efforts to notify Providers of significant changes that affect their use of the Platform.
If we discontinue the Platform entirely, we will provide at least 30 days' notice to active Providers and refund any prepaid subscription fees for the unused portion of the billing period.
14. AI-Generated Content
The Platform uses artificial intelligence to generate content for Provider booking pages, including business descriptions, service descriptions, and page layouts based on information provided during onboarding.
Regarding AI-generated content:
- AI-generated content is provided as a starting point and may require review and editing by the Provider
- We do not guarantee the accuracy, completeness, or suitability of AI-generated content
- Providers are solely responsible for reviewing, editing, and approving all content displayed on their booking pages
- We reserve the right to moderate, edit, or remove AI-generated content that violates our content policies or applicable laws
- AI-generated content may not be used outside the Platform without our prior written consent
By using the AI content generation features, you consent to the processing of your business information by our AI systems for the purpose of creating your booking page content.
15. Electronic Communications
By creating an account on the Platform, you consent to receive electronic communications from us, including:
- Booking confirmations, reminders, and status updates (transactional)
- Account-related notices, including security alerts and policy changes (administrative)
- Tips, feature announcements, and promotional content (marketing, with opt-out)
Transactional and administrative communications are essential to the operation of your account and cannot be opted out of while your account is active. Marketing communications can be opted out of at any time through your dashboard settings or by following the unsubscribe link in any marketing email.
You agree that electronic communications satisfy any legal requirement that such communications be in writing.
16. Force Majeure
Neither party shall be liable for any failure or delay in performing its obligations under these Terms to the extent that such failure or delay results from events beyond the party's reasonable control, including but not limited to natural disasters, wars, terrorism, riots, pandemics, government actions, power failures, internet or telecommunications failures, cyberattacks, or failures of third-party service providers (including payment processors).
In the event of a force majeure occurrence, the affected party will make reasonable efforts to mitigate the impact and resume performance as soon as practicable.
17. General Provisions
Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
Entire Agreement
These Terms, together with our Privacy Policy, Cookie Policy, Dispute Policy, and Cancellation Policy, constitute the entire agreement between you and DB Island Inc. regarding your use of the Platform. They supersede all prior agreements, representations, and understandings.
Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms to a successor entity in connection with a merger, acquisition, or sale of all or substantially all of our assets.
Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of DB Island Inc.
Notices
We may provide notices to you via email to the address associated with your account, through the Platform dashboard, or by posting on our website. You may send notices to us at support@booknjob.com. Notices are deemed received when sent by email (on the next business day), or when posted on the Platform (immediately).
18. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or the Platform shall first be attempted to be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within 30 days, either party may pursue resolution through binding arbitration administered under the rules of the American Arbitration Association, with the arbitration taking place in Wyoming, United States.
Notwithstanding the above, either party may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property rights or confidential information.
You agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class, consolidated, or representative action.
